Freedom of Information Act


Procedure:

All requests should be made through the Executive Director. In accordance with the Freedom of Information Act, requests must be made in writing.

Requests will be dated when received to ensure compliance within the fifteen (15) day limit.

The Executive Director shall consult with Regional and State authorities pertaining to those requests that may conflict with issues of confidentiality, client rights and/or immanent or pending litigations. In certain cases consultation with an agency attorney and/or the legal department of the South Carolina Department of Disabilities and Special Needs may be sought. Confidential information will be blackened out on copies requested.

The agency may require that the individual submitting the request make restitution to the agency at the rate of 0.20 per page.

All MDCBDSN Board meetings will serve notice and comply with the Freedom of Information Act.

Purpose

This policy establishes procedures for compliance and handling of all requests for information under the Freedom of Information Act.
